This notice explains how Manchester Independent Mortgages Ltd collects, uses, shares and protects your personal data when you use our mortgage, protection and insurance advice services.

Who we are

Manchester Independent Mortgages Ltd ("we", "us", "our", "MIM") is a mortgage, protection and insurance brokerage based in Worsley, Greater Manchester. We are directly authorised and regulated by the Financial Conduct Authority (FCA) under firm reference number 431647. You can check our authorisation on the Financial Services Register.

When you deal with us, we collect and use personal data about you. In doing so, we act as a data controller and are responsible for that data under the UK GDPR and the Data Protection Act 2018.

What personal data we collect

Depending on the service you ask us to provide, we may collect and use the following personal data about you:

  • Identity data — name, date of birth, marital status, nationality, photo ID
  • Contact data — address, email address, phone numbers
  • Financial data — income, outgoings, assets, liabilities, bank details, credit history
  • Property data — details of the property you are buying, remortgaging or letting
  • Employment data — employer, job title, length of service, self-employment accounts
  • Application data — details you give us on application forms, and information about the product you take out
  • Identification and verification data — copies of ID documents, and results of identity and sanctions checks
  • Special category data — health information and, where relevant, information about dependants, beneficiaries or vulnerabilities (see Special category data below)

If you give us personal data about another person, for example a joint applicant, dependant or beneficiary, please make sure they know you are doing so and are happy for their information to be shared with us. You may find it helpful to show them this notice.

Where we get your information from

We collect personal data:

  • Directly from you — when you contact us, complete a fact-find, or provide documents in support of your application
  • From lenders and product providers — once a mortgage, protection or insurance product is in place
  • From credit reference agencies and identity verification agencies — to confirm your identity and assess affordability
  • From other professionals involved in your case — such as solicitors, estate agents or accountants, where relevant to your application

Where we receive information about you from someone else, it is their responsibility to make sure they have told you they are sharing it with us.

How we use your personal data

The list below sets out what we use your personal data for, the lawful basis we rely on, and who we typically share it with.

  • Assessing your needs and providing advice — lawful basis: performance of a contract; legitimate interests. Typically shared with: not routinely shared
  • Researching and recommending suitable products — lawful basis: performance of a contract. Typically shared with: lenders, insurers, mortgage clubs/networks
  • Submitting and managing your application — lawful basis: performance of a contract. Typically shared with: lenders, insurers, solicitors
  • Verifying your identity and preventing fraud — lawful basis: legal obligation; legitimate interests. Typically shared with: credit reference and identity verification agencies
  • Meeting our regulatory and legal obligations — lawful basis: legal obligation. Typically shared with: FCA, auditors, our professional indemnity insurer
  • Sending you information about products or services that may interest you — lawful basis: consent. Typically shared with: not shared for marketing purposes

We rely on "legitimate interests" only where we have considered that our use of your data is proportionate and does not unfairly affect your rights. You can ask us for more detail on any legitimate interests assessment we have carried out.

Special category data

Some personal data is treated as more sensitive under data protection law and is subject to extra safeguards. This is known as "special category data" and includes information about your health, and data relating to criminal convictions or offences.

We may process:

  • Health and lifestyle information, when advising on or arranging a protection insurance product, such as life cover, critical illness cover or income protection
  • Criminal conviction or offence information, when advising on or arranging a general insurance product, or where relevant to our anti-money laundering and financial crime checks

Where we process this information, we do so for the purpose of advising on, arranging or administering an insurance contract, for compliance with our regulatory obligations, or for the establishment, exercise or defence of legal claims.

Marketing

We will only send you marketing about our products and services where you have given us your consent to do so, and in line with any preferences you have told us about.

Opting out of marketing does not stop us sending you important information relating to your mortgage, protection or insurance application.

Who we share your data with

We share your personal data, where necessary, with:

  • Lenders, insurers and product providers, to obtain quotes and process your application
  • Mortgage clubs, networks and sourcing platforms we use to research the market on your behalf
  • Credit reference agencies and identity verification providers, to confirm your identity and assess affordability
  • Solicitors, conveyancers and other professionals involved in your transaction, where relevant
  • Our professional advisers, including auditors and our professional indemnity insurer
  • The FCA and other regulators, where we are required to report or disclose information

We do not sell your personal data to third parties.

Transferring your data outside the UK

We do not transfer your personal data outside the UK or the European Economic Area (EEA). If this were ever to change, we would update this notice and put appropriate safeguards in place before doing so.

How long we keep your data

We keep your personal data for as long as necessary to provide our services and to meet our legal and regulatory obligations. As a firm regulated by the FCA, we are required to keep certain records for a minimum period after our relationship with you ends, typically 6 years, though some records, for example those relating to pension transfer advice, may need to be kept for longer.

Your rights

Under data protection law, you have a number of rights in relation to your personal data:

  • Access — ask us to confirm what personal data we hold about you and get a copy of it
  • Correction — ask us to correct inaccurate or incomplete data
  • Erasure — ask us to delete your data, where we no longer need it or you withdraw consent
  • Restriction — ask us to limit how we use your data in certain circumstances
  • Objection — object to our use of your data where we rely on legitimate interests
  • Portability — ask us to transfer your data to you or another organisation, in certain circumstances
  • Automated decisions — ask us to review any decision made about you solely by automated means, where that decision has a legal or similarly significant effect on you

We do not currently make any decisions about you based solely on automated processing.

To exercise any of these rights, please contact us using the details below. We may ask you for proof of identity before we act on your request, and we aim to respond within one month. We will not usually charge a fee, unless your request is unfounded, repetitive or excessive.

Keeping your data secure, and how to contact us

We have appropriate technical and organisational measures in place to protect your personal data from being lost, misused or accessed without authorisation. Access to your data is limited to those who need it to do their job, and we have procedures in place to deal with any suspected data security incident.
